These Seller Terms apply when you list, promote, offer, sell, transfer, or arrange the sale of goods or services through Seconds. They supplement the Terms of Use. If there is a conflict, these Seller Terms apply to your seller activity.

1. Seller responsibility

You are responsible for your Listings, items, communications, taxes, customer support, and compliance with law. Seconds provides marketplace tools, but you remain responsible for what you sell and how you sell it.

You represent and warrant that:

  • you own the item or have the legal right to sell it;
  • the item is authentic and not counterfeit, stolen, recalled, unsafe, restricted, or illegal;
  • the Listing is accurate, complete, current, and not misleading;
  • the price, condition, pickup or delivery details, included accessories, defects, and limitations are clearly disclosed;
  • the sale does not violate law, sanctions rules, payment-network rules, or Seconds policies.

2. Listings and seller content

You grant Seconds the rights described in the Terms of Use to host, display, format, translate, analyze, promote, and distribute your Listings and seller content in connection with the Platform.

You must keep Listings accurate and remove or update them promptly when:

  • an item is sold, unavailable, damaged, recalled, restricted, or no longer lawful to sell;
  • the condition, price, pickup details, or included accessories change;
  • you receive a safety notice, intellectual property complaint, authenticity complaint, or recall notice.

Seconds may review, rank, moderate, remove, label, demote, or limit Listings at any time. Any review by Seconds does not make Seconds responsible for your Listing or item.

3. Prohibited and restricted items

You may not list, sell, promote, or facilitate prohibited items or activity. You are responsible for reviewing and complying with the Prohibited Items Policy before posting.

Seconds may remove a Listing or restrict a Seller when an item creates legal, safety, fraud, payment, reputational, or platform-integrity risk, even if the item is not specifically named in the policy.

4. Buyer terms and customer support

You are responsible for communicating clearly with Buyers and for honoring any sale, return, pickup, delivery, warranty, refund, or other terms you state in a Listing or message, unless those terms conflict with Seconds policies or applicable law.

You are responsible for:

  • answering reasonable Buyer questions;
  • arranging pickup or delivery where applicable;
  • providing accurate proof of exchange when requested;
  • handling ordinary buyer support for your items;
  • cooperating with Seconds when a Buyer reports fraud, safety concerns, item-not-received, or item-not-as-described issues.

5. Payments and payout eligibility

Seconds may make payment and payout features available through Stripe or another Payment Processor. To use those features, you may need to:

  • accept the Payment Processor’s terms;
  • provide identity, business, bank, tax, and verification information;
  • maintain an eligible and active connected account;
  • satisfy fraud, risk, sanctions, and compliance checks;
  • keep payout information current.

Seconds may delay, pause, cancel, reduce, withhold, reverse, or condition payouts if needed to manage refunds, chargebacks, disputes, fraud, negative balances, payment-processor requirements, legal compliance, policy enforcement, or Seller risk.

6. Refunds, reversals, and chargebacks

You are responsible for refunds, reversals, chargebacks, disputes, fees, fines, negative balances, and related costs arising from your Listings, Transactions, promises, omissions, product issues, or policy violations.

If a Buyer, Payment Processor, financial institution, card network, regulator, or court causes Seconds to be debited, fined, charged, or otherwise exposed because of your seller activity, you agree that Seconds may:

  • reverse transfers or recover funds from you;
  • offset the amount from current or future payouts;
  • place a reserve or hold on your funds;
  • request direct repayment;
  • suspend or terminate your account or payment access.

7. Dispute cooperation and evidence

You must cooperate with Seconds and any Payment Processor in fraud reviews, refund requests, chargebacks, and disputes.

You should keep:

  • Listing screenshots and item photos;
  • Buyer messages and agreed terms;
  • proof of pickup, delivery, or handoff;
  • proof of refund or cancellation;
  • authenticity, ownership, serial number, or condition records where relevant.

Failure to provide timely evidence may result in a refund, lost dispute, payout hold, account restriction, or other enforcement action.

8. Taxes and legal compliance

You are responsible for determining whether you owe income, sales, goods and services, harmonized sales, provincial, local, import, customs, or other taxes and charges related to your Listings and Transactions.

You agree to provide accurate tax information when requested and to indemnify Seconds for taxes, penalties, interest, reporting failures, or claims arising from your seller activity, except where Seconds is legally required to collect or remit a specific tax.

9. Product safety, defects, and recalls

You are responsible for product integrity and safety. You must not list items that are recalled, hazardous, unsafe, defective in an undisclosed way, or subject to sale restrictions.

If you learn of a recall, safety issue, defect, authenticity issue, stolen-property claim, or legal restriction affecting an item, you must immediately remove the Listing, notify any affected Buyer, and cooperate with Seconds.

10. User data

You may use Buyer information only to complete the relevant Transaction, provide related support, comply with law, or for another purpose the Buyer has clearly consented to.

You must not sell Buyer information, add Buyers to marketing lists without consent, harass Buyers, scrape User data, or use information obtained through Seconds outside the purpose for which it was provided.

11. Enforcement

Seconds may remove Listings, limit visibility, require verification, delay payouts, refund Buyers, restrict payment access, suspend accounts, report activity, or terminate Seller access if we believe your activity creates legal, safety, fraud, payment, privacy, tax, or trust risk.

Sections relating to payments, refunds, disputes, taxes, User data, indemnification, enforcement, and liability survive termination of your seller access.
